What is the leave donation?
The gift of leave to a colleague is a practice which consists in offering one's days off to another employee. Still called Reduction of Working Time (RTT), it was once a practice only reserved for the private sector. It was not until 2018 that it was extended to the public sector and the army.
This donation is based exclusively on volunteering. In other words, the employee who does donation of days off does it without any constraints. Finally, it should be noted that these are days of leave not taken and that only employees of the same company can benefit from them.
What are the reasons for donating leave?

To help an employee with a sick child
Le donation of days offs is a practice that particularly concerns employees with a sick child. It was introduced by the Mathys law in 2014 and only concerns children under the age of 20 and suffering from a serious illness. It also takes into account children who are victims of an accident and whose care requires a permanent presence.
To relieve an employee caring for a sick relative
Le donation of days off can also be done to help a colleague who is caring for a sick person. The relative can be a spouse, an ascendant or any person with whom the employee has close ties. Finally, it should be noted that this person must have resided on French territory for at least three months.
To relieve a colleague who has lost a child
It is also possible to offer his days off to a colleague who has lost a child or a person for whom he is responsible. However, the latter must be at least 25 years old.
To help a reservist
It is finally possible to offer your days off to a colleague engaged in an operational military reserve. The latter can thus benefit from several additional days in addition to the eight days provided for by law.
What types of leave can be given?
All types of leave can be offered within the framework of an RTT with the exception of the first 04 weeks of paid leave. It is thus possible to offer his fifth week of paid leave from RTT. The donation can relate to all or part of the days of leave. It should also be noted that the beneficiary employees retain their remuneration during the period of their absence.
How to give leave to a colleague?
The procedure for donating leave is relatively simple. The employee wishing to offer his days off must make the request to his employer as far as the private sector is concerned. Regarding donation of public service leave, the employee must instead make a written request to the administration. The beneficiary must, for his part, provide a medical certificate attesting to the seriousness of the illness of his child or the sick parent. The gift of leave generally results in a contract or signed document which specifies the number of days offered. It can be done anonymously or not.
